Chokala is a creator-hosting platform for tipping, fundraising, and link-in-bio surfaces. These
Terms govern your use of the Chokala platform itself
(browsing the marketplace, creating an account, discovering creators).
Each individual creator's profile (accessible at
chokala.gg/@<creator>/) operates under that
creator's own posted Terms of Service; please read those before
sending a tip or contribution.
1. Acceptance
By accessing chokala.gg (the "Platform"), creating an account, browsing creator profiles, or otherwise using the Platform, you agree to these Terms of Service ("Terms") and to the Privacy Policy. If you do not agree, do not use the Platform.
2. Definitions
- "Platform" means chokala.gg and the hosting, discovery, and account-management services offered by Chokala to its creators and visitors.
- "Creator" means an individual or entity that has
registered an account on the Platform to host a public profile at
chokala.gg/@<handle>/or at a connected custom domain. - "Visitor" means any person who accesses the Platform without being signed in as a Creator.
- "You" means the Creator or Visitor, as applicable.
3. Platform-as-a-service
Chokala provides hosting, discovery, payment-processor integration, and account-management infrastructure. Chokala is not a party to the relationship between a Creator and a Visitor sending a tip, contribution, or other payment. Each Creator is solely responsible for the content, claims, and offerings on their profile.
Payments are processed by third-party payment processors (currently PayPal; additional processors may be added). The Creator's own Terms of Service govern the substantive terms of any payment; these Platform Terms govern only the Platform-hosted infrastructure that surfaces the payment flow.
4. Creator content ownership
Creators retain ownership of all content they upload to the Platform (text, images, video, audio, stream titles, descriptions, etc.). By uploading content, a Creator grants Chokala a non-exclusive, worldwide, royalty-free license to host, cache, transcode, and serve that content as necessary to operate the Platform. This license terminates when the Creator deletes the content or terminates the account, except for backups retained per the Privacy Policy's stated retention windows.
Visitors do not acquire any ownership or license rights in Creator content by viewing, sharing, or supporting it through the Platform.
5. Acceptable use
You may not use the Platform to:
- Violate any applicable law or third-party right.
- Post content that is unlawful, defamatory, harassing, threatening, obscene, or that infringes any intellectual-property right.
- Impersonate another person or misrepresent your affiliation with any person or organization.
- Engage in fraud, money laundering, or evasion of payment-processor or tax-reporting obligations.
- Probe, scan, or test the vulnerability of the Platform; attempt to bypass any access control; or interfere with the Platform's operation.
- Scrape, harvest, or collect Visitor or Creator data via automated means without Chokala's prior written permission.
Chokala may suspend or terminate any account that violates this section, with or without notice, at Chokala's sole discretion.
6. Account termination
You may terminate your account at any time by contacting legal@chokala.gg or via any account-deletion control surfaced in the Platform's account settings. Chokala may suspend or terminate any account at any time, with or without cause and with or without notice, including for any violation of these Terms.
Sections 3 (last paragraph), 4 (last sentence), 5, 7, 8, 9, 10, 11, 12, and 13 survive termination.
7. Limitation of liability
To the maximum extent permitted by law, Chokala's total aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the total fees, if any, you paid to Chokala in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US $100). In no event will Chokala be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, lost goodwill, or business interruption, even if advised of the possibility of such damages.
Chokala is not liable for the acts, omissions, content, or offerings of any Creator or Visitor on the Platform. Disputes between a Visitor and a Creator (including refund disputes, content disputes, and offering-fulfillment disputes) are resolved between the Visitor and the Creator under the Creator's own Terms; the Platform is not a party.
8. Indemnification
You agree to indemnify and hold harmless Chokala from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the Platform, (b) your violation of these Terms, (c) your violation of any applicable law or third-party right, or (d) for Creators, any claim brought by a Visitor or third party arising out of your content, offerings, or conduct on the Platform.
9. User content + section 230
The Platform is an interactive computer service within the meaning of 47 U.S.C. § 230. Chokala is not the publisher or speaker of any User Content provided by another person (Creator or Visitor). Chokala may, but is not required to, moderate, edit, or remove User Content at any time without notice.
10. Governing law and venue
These Terms are governed by the laws of the State of [OPERATOR-FILL: state], without regard to its conflict-of-laws principles. Any dispute that is not subject to the arbitration provision in Section 11 shall be brought exclusively in the state or federal courts located in [OPERATOR-FILL: county, state], and you consent to personal jurisdiction in those courts.
11. Arbitration and class-action waiver
Except for claims that may be brought in small-claims court and except for claims for injunctive relief related to intellectual- property rights, you and Chokala agree that any dispute arising out of or relating to these Terms or your use of the Platform will be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration may be conducted in [OPERATOR-FILL: jurisdiction] or, at your election, remotely by telephone or video.
Class-action waiver. You and Chokala agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to legal@chokala.gg within thirty (30) days of your first acceptance of these Terms.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.
13. Changes to these Terms
Chokala may update these Terms from time to time. Material changes will be announced on this page or by email at least thirty (30) days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
